Let's go through those one by one:
1- If the material is copyrighted, and the copyright holder has not given their permission for the music to be downloaded, then yes, it's illegal.
2- Downloading copyrighted material is banned. Operating a website where copyrighted material is downloaded is slightly different. Most downloading takes place on file-sharing websites, where you can upload stuff, give the link to your friends, and download it. That sort of website is not illegal, and you're allowed to operate such a website. It's only uploading or downloading copyrighted material that's illegal.
The catch is that the internet is a big place, with relatively little law enforcement activity. The police don't have the resources to track down every illegal downloader there is, and in general you can get away with it.
3- Legally, you cannot put copyrighted material for download on your website, unless your usage of it is classified under fair use (simply putting it up for download wouldn't count as fair use). As mentioned, though, it is highly unlikely that you'd face any legal trouble over this.
You can see if the music you want to use is in the public domain. If it is, then you are allowed to use it for whatever you like.
